How To Sell Brand Name Products on Amazon (Legally)

Even though the Chinese are dominating Amazon, not all hope is lost:). In fact, small business owners are still thriving.

Every year, my buddy Andrew Youderian of Ecommerce Fuel conducts a survey of ecommerce merchants making 6, 7 and 8 figures in annual revenue and here are some highlights from his findings.

Out of over 450 ecommerce businesses surveyed

  • Average Revenue Per Store Was 2.4 Million
  • Average YOY Revenue Growth Was 36.8%
  • Private Label Growth was 43.1%
  • Average Gross Margins Were 39.2%

As you can see, the small business ecommerce market is still alive and kicking and the key stat to focus on above is that average gross margins did not drop year over year despite the Chinese competition!

In fact last year, gross margins from the shops surveyed were pretty much identical at around 39%.

Why is the small business ecommerce market holding strong?

First off, theres a misconception that ecommerce is nearing saturation in the US. But did you know that ecommerce represents only 9% of overall retail sales?

9%!!!! Thats nothing!!!

Ecommerce is growing at over 10% per year and its not even close to being saturated. A rising tide lifts all ships.

Second of all, Amazon is growing at over 30% per year. There doesnt seem to be any end in sight and there are still many opportunities abound!

If you are discouraged from starting your own ecommerce business, just know that ecommerce still has a long path of growth ahead of it.

Which Type Of Amazon Business Model Are You

There are several different business models when selling on Amazon. The business model you choose may end up having a big influence on the seller name you choose, and how important the name is for your business.

Popular Amazon seller business models:

  • 3rd party Selling New items: 3rd party sellers that get wholesale items from reputable, household brands and resell them under Other Sellers on Amazon
  • 3rd party Retail arbitrage: the exact same as above, except they dont buy wholesale. Instead, they buy from local stores and take advantage of lower prices or sales from their local stores.
  • 3rd party Selling Used items: 3rd party sellers who list or buy and sell used books on Amazon, used games, used products, etc
  • Private label: Those who buy wholesale from China, but they self-brand those products .
  • Unique products: Those who create or invent their own products, or possibly alter existing products to their specifications .

For example, choosing a good name may matter more to those that have their own line of branded products. It could be that you are selling private label products or youve developed your own line of unique products. In these cases, you are essentially picking a brand name.

On the contrary, a 3rd party reseller who sells a variety of other manufacturers products may have success using nearly any business name, as long as they keep their reviews high prices low.

Can I Sell On Amazon Without Joining The Brand Registry

Yes, you can sell on Amazon without joining the brand registry. However, it does come with a few risks. The most common is having your listings hijacked by the competition selling counterfeit or knock-off products.

Another common problem is low-cost manufacturers selling a similar product at a reduced price. These two issues can result in category saturation. The only way to compete is with dramatic price drops to remain competitive.

Listing Without Brand Registry

HiNew to amazon and already have a a problem i hope someone could help me with.I have my own brand of cosmetic product all ready to list , all boxes marked up with gtin 13 barcodes from GS1, My problem is that my name isnt fully trademarked yet as i have an opposition to it that im fighting and believe i will win . my logo is trademarked but without the brand name. when i try to list my products with the gtin , amazon tells me i have to brand register, which im unable to do yet until the name is trademark registered, Does anyone please know a way for me to list until i can give them the trademark details they need?. Thank you

For Brand Registry, trademark has to be granted, it cant be in the process of being granted.

I believe when you go to list a product you can put the brand name as NA, and when trademark is granted you can change to your brand name. But youll not be able to get Brand Registry until its granted wit IPO/EUIPO. I may be incorrect here, as ive never tried this, but hopefully someone can follow up.

Getting Lazy With Listings

This becomes all too easy to do when youve got a large catalog or a jam-packed schedule. However, you do yourself a disservice by taking a set-it-and-forget-it approach to listing, or copying and pasting your listings from one channel to another.

Not only do you risk duplicate content issues on Google, where Amazon will almost always rank above your site pages, but you also risk getting overlooked or penalized by Amazons algorithm.

For instance, traditional SEO favors shorter titles, but on Amazon, longer, more detailed titles often rank higher. Third-party sellers are known to max out their character counts using this type of approach, one brand drove seven times more monthly orders to their listings within two months of updating their titles.

Data quality can also be a make-it-or-break-it factor on Amazon. Brands too often miscategorize their listings or skimp on product details, destroying their changes of ranking on the first page of their target category.

To complicate things further, Amazon is known to automatically re-classify ASINs if words within the listing suggest it belongs to a different category, and its entirely on you to report these errors to Seller Support. Case in point: this HEXBUG toy was miscategorized as a pesticide by Amazon, according to its seller.

Pricing Too High Thinking Your Branding Will Win Out

Amazon isnt a cakewalk for any brand. Its one of the rare places where the playing field is level between brands big and small where a strong reputation doesnt equate to immediate success, due to the wide range of alternatives available on the site.

There is also evidence to suggest that most buyers on Amazon arent brand loyalists. 78% of searches on Amazon are unbranded, and 65% of surveyed consumers said they feel comfortable buying from sellers theyve never heard of before on marketplaces.

As a result, companies that place too much store in their branding when they set their prices on Amazon can wind up hurting their chances of success. We see this in the pet category, where Furbo prices its dog camera nearly three times higher than its closest competitor at times.

Amazon sales for Furbo are volatile year round, as reflected in data from AMZScout, and only seem to jump momentarily during the holidays. Furbos rankings decline during other times of the year, when lesser known, more affordably priced competitors are able to swoop in.

The takeaway: Check your ego at the door and do your due diligence before solidifying your . Its possible that some of your products arent appropriate for Amazon if the playing field consists of mostly dirt cheap alternatives. Or, Amazon may be better suited for liquidating your out-of-season or excess inventory. Either way, dont bank on your brand being the exception to the rule on Amazon.

How To Sell Your Own Branded Products On Amazon

If you have your own, branded, products to sell and you are the only supplier/seller of them then you can ensure that you are the exclusive seller on Amazon by registering for their Brand Registry.

Amazon Brand Registry is suitable if you manufacture your own products, you produce branded, custom and hand-made products, youre a private label brand owner, or you are the only distributor of a product on Amazon.

Once you have applied to the Brand Registry and been approved you will be given unique Amazon Standard Identification Numbers for your products and no other sellers will be able to list the same items from your detail pages. You will have complete control over the content of your product detail pages including the product descriptions and photographs. It also has the added benefit that as the only seller for that product you will always have the Buy Box for them.

To apply for Amazon Brand Registry you will need to provide:

  • Your brand name thats registered as a trademark
  • Trademark number

How I *LEGALLY* Sell Name Brand Products on Amazon FBA

If you would like to join the Amazon registry with a pending trademark, its by invitation only in the United States and India. To join the pilot program, you need to register your interest by joining the waitlist.

For consideration, youll need to have a pending trademark registration in the US or India, an active Amazon Seller Central or Vendor Central account, and not already be enrolled in the Brand Registry with a registered trademark. The Amazon team will review your request and contact you when you can start your Brand Registry application.

How Long Does It Take For Amazon Brand Registry Approval

Assuming that you already have a trademark, or youve submitted a request through the IP Accelerator program, the entire approval process should take about two weeks. Just make sure you submit everything Amazon needs for your brand the first time around.
